“Natural person”, “natural persons”, and “person” refer to a human being born from a mating process of a natural male and natural female that is the older of (i) the age of majority to make e-commerce purchases in their respective country, or (ii) 18 years of age.
“Broker”, “Brokerage”, “Broker[age]-dealer”, and “Dealer”, unless otherwise stated, refers to a 3rd party company who is licensed in their respective jurisdiction to accepts orders to buy and sell over the counter (OTC) CFDs in an account held as such company, on behalf of retail clients.
“Forex pairs”, “fx pairs”, “stocks”, “index”, “indices”, “commodities”, “bonds”, and “crypto”, unless otherwise stated, refer to over-the-counter (OTC) CFD derivatives of their respective category that are traded at a brokerage. These products are not traded on a regulated exchange.
“cfd”, “cfds”, and “contract for difference” refer to an over-the-counter derivative bought or sold at a brokerage designed to speculate on the price movement of the underlying asset priced into said derivative. CFDs are not traded on a regulated exchange, although their pricing may be derived from exchange products.
“Trade”, “trade operations”, and “trading” refer to the act of buying, selling, or offsetting a cfd position in either a demo or real account of a brokerage through a trading terminal.
“Trading strategy” and “strategy” refer to
“Terminal”, “trading terminal” and “trading platform” refer to the software that connects to the broker that. Trading terminals may host real or demo accounts.
“Indicator” and “indicators” refer to programs that run on trading terminals or elsewhere that make proprietary calculations, but do not make any trade operations.
“Expert advisor”, “EA”, “algo”, “robot”, “trading bot”, “trading script”, “script”, “auto trade”, and “automated trading”, unless otherwise stated, refer to a proprietary indicator, trading system, or other program capable of running calculations that either facilitates or result in opening and/or closing trades on a trading terminal with minimal or no human intervention. There may be more than one type of EA or script, in which the specific name/version number will be explained on the respective product page.
“Software” refers to any EA, indicator, or other script sold or made available by us, that is licensed by us, and is made available for you to use.
“Trade Secrets” and “secrets”, unless otherwise stated, refer to all information possessed by or developed for us in which the following apply: (i) the information derives independent economic value from not being generally known and (ii) we take reasonable precautions to prevent such information from being disclosed and released to the public.
“Confidential Information” refers to information or materials that are not necessarily a trade secret, but that either (i) has not otherwise been made available to the public or (ii) holds proprietary value to us.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Thailand. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Who can access and use this site

Only natural persons can use this site. Bots, scrapers, or any other mechanical or software device that meet the following criteria: (i) are not directly operated by a natural person in real time, or (ii) are not otherwise granted permission in this agreement or explicitly from us, are prohibited from accessing this site.

We employ the use of cookies. By accessing AwarenessForex, you agreed to use cookies in agreement with the AwarenessForex’s Privacy Policy.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Software End User License Agreement

By way of the installation, copying, downloading, accessing or otherwise use of this product, you are agreeing to be legally bound by the herein contained terms of this license agreement. If you do not agree to be bound by the terms of this EULA, you then have no rights to the product and should therefore not install, copy, download, access nor use the product.

Unless otherwise stated, the purchase date timestamp is used to determine the license start date. For custom courses or consultation contracts, the date time stamp that payment or deposit is received is considered the start.

Trade secrets protection

There may be some proprietary information we have that, if released to the general public, may cause some aspects of any trading strategy to become less effective. In such cases, a non-disclosure agreement (NDA) may be required to be executed prior to the release of said information. You will be informed if execution of (NDA) and/or non-compete agreement (NCA) is necessary as a condition of continued membership, course, or end-user licensing/usage of any of our software. We will provide you with such agreement via secure document portal in which you will use an e-sign format.

You agree to abide by all terms of the (NDA). Failure to do so may result in software becoming unusable. The parts of the software not under NDA will continue to be functional. But precise operation may not be possible without the trade secrets.

Exceptions

The provisions of this Agreement will not be deemed to prohibit any disclosure that is required by law or court order, however you agree to provide us with reasonable prior notice and an opportunity to contest or minimize such disclosure. In addition, conditional upon a written release from this Agreement by us, you may disclose Confidential Information or Trade Secrets specified in the release.

Updates

EA, scripts, and other software may occasionally require updates to continue to function on newer versions of trading platforms. You must be on an active service plan in order to be entitled to free updates stated in such plan. Otherwise, you may have to pay a fee to facilitate the upgrade. Or continue to use an older version of the trading platform to continue using the product.

We strive to keep all items on the site up-to-date to function with the latest version of trading platforms. However we have no control over 3rd party trading platforms, and therefore any sort of timeframes are never guaranteed.

General Site License

Unless otherwise stated, AwarenessForex and/or its licensors own the intellectual property rights for all material on AwarenessForex. All intellectual property rights are reserved. You may access this from AwarenessForex for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

Republish material from AwarenessForex
Sell, rent or sub-license material from AwarenessForex
Reproduce, duplicate or copy material from AwarenessForex
Redistribute content from AwarenessForex

This Agreement shall begin on the date of the first instance you visit the site hereof.

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. AwarenessForex does not filter, edit, publish or review comments prior to their presence on the website. Comments do not reflect the views and opinions of AwarenessForex, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, AwarenessForex shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

AwarenessForex reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

You warrant and represent that:

You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;
The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;
The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy;
The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant AwarenessForex a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.

Payment Processing

Our order process is conducted by invoice processing from 3rd party processors, such as Skrill, Wise, WorldRemit, or Bank transfer. These are secure payment methods.

Orders from the MQL market channel are done through the MQL market. Any customer service issues related to payment must be made directly with MetaQuotes via their service desk.

Refund Policy

The nature of proprietary indicators, potential signals, and trading products is such that they provide some kind of immediate benefit to the user that they either cannot or would not get anywhere else. Significant time is also invested by us for product research, development, and/or to prepare an estimate to see if the product will fit our client’s needs. We offer a hassle-free and straightforward way to test or verify if our products or services will suit you. If you are unsatisfied with any of these products within a specified period of time, you may be entitled to a refund. Below is a table explaining the policy for each product or service in plain language:

*Note that return payment processor may charge additional fees to recipient, as it is considered a new payment transaction.

If there were any additional terms and conditions of service for a specific product or service that are sent to you and you agreed to, those terms may supersede the ones here.

EU 14-Days Return Policy

Based on EU law, you may withdraw the purchase and receive a refund for any digital content (or service) purchased on the site during 14 days, only if you did not download the content and did not install it on the site and only if we did not start working on the requested development project (including but not limited to: CT Apami classic EA, APAMI indicator, Managed trading signals, scam investigation consultations, market microstructure course, screen video surveillance course). Once a digital product has been downloaded and/or a purchased service has commenced, customers immediately lose their right of withdrawal.

Site Content

AwarenessForex is free, at our own discretion and without any sort of notification – to remove or pause content from the site, including but not limited to: EA product pages, Indicator product pages, articles, blog posts, copy signal offers, investigative consultation.

Users that have acquired an item that has been removed or discontinued, will still be able to access their item and download it through their purchase receipt (if they are eligible for a download), but updates will not be received.

Hyperlinking to our Content

(1) The following organizations may link to our Website without prior written approval:

Government agencies;
Search engines;
News organizations;
Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Fair Play and Conduct

Your usage of AwarenessForex.com including all available content and the items must comply with our fair use policy. Being a Subscriber/Member is not an automatic right, it is a benefit for those who follow our reasonable rules. We hope that you will be with us for a long time. But we may be using reasonable discretion, decide whether or not your use of AwarenessForex.com complies with these terms. We can suspend or terminate your subscription or license at any time for any reason (acting reasonably of course) including:

if you breach these terms;
if you act in a way that does not align with the values of our community; or
if you act in a way that could cause us or others harm.

If we do decide to permanently terminate your AwarenessForex.com account you must not apply for a new account as unfortunately, you will no longer be welcome.

No refunds will be provided to customers who have their accounts terminated. Examples of reasons for termination may include:

Abusive behavior and/or excessive negativity towards our staff and/or other customers;
Repeated defamatory, malicious, and/or false statements including slander against us, and/or attempts to persuade potential customers away from purchasing our products;
Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts;
Attempting to circumvent our fair use policy (see below).

Fair use policy

We operate a fair usage policy. AwarenessForex.com indicators and expert advisors are for real individual people (or businesses/agencies) to use, using their real details within the scope of the license. You are prohibited from using any methods to circumvent licensing, including decompilation, reverse engineering, hacking, copying signals (beyond what is explicitly allowed in license), sharing with other individuals, or any other methods of attempting to circumvent fair use.

We do not allow sharing, reselling, or stacking up our products.

This is expressly forbidden and no refunds will be provided.

Severability

If a court finds that any provision of this Agreement is invalid or unenforceable, the remainder of this Agreement shall remain in force and be interpreted so as to best effect the intent of the Parties.
